I agree this would classify as parody, as in the case of Warhol's soup cans - clearly appropriated, but public unlikely to view the fabric as sponsored by the toothpaste or representing a competing fabric.

It was put on the market and it wasn't until someone tried to buy it that it was deemed a possible copyright violation and I then removed it. I have two yards of it. As I said, all my life I have seen velvet Elvis' being sold and had no clue that it was against copyright laws to even paint a picture of Elvis. Who would have thought as so many celebrities are painted all the time. I wasn't intentionally violating anything. I wish I had bought more of it before it was discovered though. I wanted to upholster a couch with it. lol.

I don't print or sell most of my contest entries. (The ones I do sell were things I already had that fit contest themes). This was drawn specifically this morning, to amuse people in the context of the contest. Only Spoonflower insiders will even get the joke. This site is full of material making money off intellectual property (check the search words Star Trek and Dr Who for starters). This wasn't even made to be sold. It was made to enter a contest and make voters in that contest chuckle. Relax. No animals were harmed in the making of this art, and no tubes of toothpaste were either. Can we agree to disagree where the use of an image is humor and where it is a for profit appropriation of somebody else's material?

By that logic everyone could download an image from the web of the latest and greatest poster or design - or download a copy of a new book or album - and print a copy without paying the artist/author/owner a penny. I did a velvet Elvis fabric for personal use. Spoonflower printed it for me but I couldn't sell it. Painting Velvet Elvis's is against copyright laws but they used to be all over the place so I didn't know that when I did mine, it was more satire. Not to say i don't love me some Elvis vocals but the guy did become a parody in a so sad way.

It is so difficult to get people to understand that it's not okay to use IP without permission of the owner. As artists we need to set a higher standard to ensure the protection of our own work. It is very possible that P&G might grant permission to use this - it's free advertising for them; much like Campbell's did with Andy Warhol. Then again they may not, but it is their right and their decision to make.

glimmericks says: You can locate the address and attorney names for this mark at P&G by searching the TESS database on uspto.gov. Just search for CREST as the full mark. There are quite a few live registrations so it could take a while to locate the correct IP attorney at P&G but they will probably not mind helping you reach the right one.
